Terms of Service

These terms are an agreement between you and WEBWISE SOLUTIONS LLC ("we", "us"), which operates BlinkPop at blinkpop.video. By creating an account or using BlinkPop you accept these terms, our Privacy Policy, Content Policy and Refund Policy. If you do not agree, please do not use BlinkPop.

Who can use BlinkPop

You must be at least 18 years old and able to enter into a binding contract. You are responsible for your account and everything done with it, so keep your password safe and tell us at once if someone else gets access.

What BlinkPop does

BlinkPop turns photos you upload into short AI videos in the style of popular trends. Results are generated by AI models and vary: a video may not look exactly like you, like the sample, or like what you expected. We may add, change or remove effects at any time.

Your photos and your rights

• You may only upload photos that you took yourself or have the right to use, and only of people who have agreed to it. Uploading a photo of someone else without their consent is not allowed.
• You keep whatever rights you have in your photos. You give us permission to store, process and send them to our AI providers only to make and deliver your videos, and to check them against our Content Policy.
• Follow the Content Policy. We may refuse a photo, block a video, or close an account that breaks it, and report illegal content to the authorities.

Your videos

Subject to these terms and the rights of anyone in your photos, you may download, keep and share the videos you make, including on TikTok, Instagram, YouTube and other platforms, for personal or commercial use. Videos are AI-generated: do not present them as real footage of events that did not happen, or use them to deceive, harass or impersonate anyone. Effects are inspired by trends; they do not include the original songs or footage, and we do not grant you any rights in third-party music, brands or characters.

Credits and payments

• Videos cost credits. The number of credits for each effect is shown before you generate.
• You buy credits as one-time credit packs shown on the Pricing page. There are no subscriptions: nothing renews or charges you again automatically. Prices are charged by Stripe in the currency shown at checkout, plus any applicable taxes.
• Credits have no cash value, cannot be transferred, and may expire if the pack says so at purchase.
• If a video fails, the credits for it are returned automatically. Other refunds follow our Refund Policy.

Things you must not do

• Break the law or anyone else's rights, including privacy, publicity and intellectual property rights.
• Get around credit charges, limits or content checks, or use bots or scripts to access BlinkPop.
• Resell or offer BlinkPop as part of another service without our written permission.
• Attack, overload or try to break into BlinkPop or its providers.

Our service

BlinkPop is provided "as is" and "as available". We do our best to keep it running but do not promise it will always be available, error-free or produce any particular result. We may suspend or close accounts that break these terms. You can stop using BlinkPop and ask us to delete your account at any time.

Liability

To the maximum extent allowed by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or reputation. Our total liability for any claim relating to BlinkPop is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.

You agree to cover our reasonable costs and losses if a claim is brought against us because of photos you uploaded or the way you used your videos.

Copyright complaints

If you think something on BlinkPop infringes your rights, follow the steps in our Content Policy.

Changes and governing law

We may update these terms. If a change is important, we will tell signed-in users before it takes effect; continuing to use BlinkPop after that means you accept it. These terms are governed by the laws of the United States and of the state where WEBWISE SOLUTIONS LLC is organized, without affecting mandatory consumer protection laws where you live.
